If you are charged with Driving Under the Influence in Delaware you are subject to severe criminal and administrative penalties that have consequences that could last a life time. You've probably already lost your driver's license. Maybe you've been issued a temporary driver's license good for 15 days. The Delaware DUI law allows only 15 days from the time of your arrest to request a hearing with the Delaware Division of Motor Vehicles. If you do not request a hearing within 15 days your driver’s license will be automatically suspended. You are running out of time. This is a complicated procedure and you should have a Delaware DUI Attorney representing your best interests and protecting your rights.
Should you fight the charge? Should you plead guilty? Should you request a hearing? Should you apply for the First Offender Program? Should you stand trial? How will a conviction effect your job? What may happen to your insurance? You need answers from someone who knows Delaware DUI law. You need Eric G. Mooney. An arrest doesn't always mean a conviction. I can help explain the charges. I can help you examine some possible challenges and I can answer all of your questions. I can help you decide the next steps to take and help you get your life back on track.
You could loose your driver’s license for a period of from three months to two years for your very first offense. You will be arraigned before a judge. If this is your first offense you may choose to apply for enrollment in the First Offender Program rather than standing trial. If you choose to stand trial and you are convicted, even though it is your first offense your driver’s license will be revoked for a period of at least 12 months, you will be fined $230 to $1,150 and you may be imprisoned.
If this is not your first conviction your driver’s license will be revoked for a period of at least 24 months to five years, you will be fined $575 to $2,300, and imprisoned.
A DUI sentence will stay on your record for a minimum of five years. Your driver’s license will not be automatically reinstated. You will have to satisfactorily complete a rehabilitation program or a driver education program. An arrest for DUI has many more serious consequences than the suspension or revocation of your driver’s license. There may be ongoing costs, employment consequences, personal and family social consequences. Let me explain why it is so important to hire an experienced Delaware DUI attorney to represent you.
